The Jones Act is a federal law that provides the right of an injured seaman to sue his employer for personal injuries sustained in the course of his or her employment as a result of premise liability. Unlike land-based employees who receive worker’s compensation based upon a no-fault scheme of compensation for employment-related injuries, a seaman injured or killed in the course of his or her employment must prove either that the vessel owner, captain or crew was negligent, a life saving product was faulty, or that the vessel was unseaworthy as defined pursuant to the general maritime law of the United States, and that the negligence or unseaworthiness was a cause of the injury for which he or she seeks compensation.
